  Gorge Trailer Lodging Agreement Terms and Conditions

 

1. Definitions: “Agreement” means all terms and conditions found in this form, any addenda and any additional materials Gorge Trailer Lodging provide at the time of rental. “Renter” means the person identified as the renter on this form, any person signing this Agreement, and any person or organization to whom charges are billed by Gorge Trailer Lodging at the organization, or the Renter’s, direction. “Gorge Trailer Lodging” or “GTL” means the business renting the trailer to the Renter or Organization. “Loss of Use” means the loss of our right to use the trailer for any reason because of damage to it or loss of it during its rental. “Loss of Use” is calculated by multiplying the number of days from the date of damage to the trailer until it is repaired or replaced times the daily rental rate.

 

2. The Renter: The Renter must be 21 years of age or older and possess a valid drivers license or state issued identification. The number of people using and staying in the trailer must be identified, and be within the sleeping capacity listed for the trailer rented. No minors will be allowed to stay in the trailer without an adult present.

 

3. Rental Day: The rental day is based on the number of nights the trailer is used, 1 night equals 1 day rental.

 

4. Campsite Selection: It is recommended that you rent your campsite before reserving a trailer. We will hold a trailer for 2 hours while you confirm a campsite. Some campsites are not designed for RV use or cannot handle longer trailers, so it is the Renter's responsibility to insure that the trailer can be delivered to the reserved site. Please see list of recommended campgrounds. Pre-approval at all other sites strongly recommended.

 

Delivery (and pickup) to campsites located within 25 miles of Hood River, Oregon is covered in the $60.00 Delivery, Set-up, and Pickup charge. Delivery to campgrounds beyond the 25 mile range will incur a $3.00 per mile charge (one-way), and must be pre-approved by Gorge Trailer Lodging. Delivery to campsites in Washington will incur a $10.00 surcharge (for bridge tolls and other charges). Gorge Trailer Lodging recommends trailers be delivered to campground sites with RV hookup (water/sewer/electrical). Delivery to sites without electricity requires a generator (may be reserved). Longer stays at dry sites (without water or sewer hook-up) require septic system dumping every 4-7 days depending on occupancy and use. The Renter will be charged a minimum of $30 per each dumping and water fill. Renter will receive first tank of propane with trailer rental. The Renter will be charged a minimum $20 refueling fee for tank refills or for additional propane tanks. 

 

5. Campsite and Non-delivery/No Show Fees: The Renter is responsible for reserving and paying for all campsite fees for the dates listed in the contract above. If the campsite is not available at the agreed upon time for trailer delivery, the Renter will be assessed a re-delivery charge of $60. Gorge Trailer Lodging is not responsible for refunding any costs associated with lack of campsite availability. If the Renter is does not meet for a Trailer Condition Check at the agreed time (within 1/2 hour) or has failed to notify Gorge Trailer Lodging of an arrival or departure change in a timely manner a $50 (minimum) return fee will be applied to the final billing.

 

6. Trailer Condition Check: To insure that trailers remain in good condition for all future Renters, we review, with the Renter, the condition of the trailer at the start and end of the rental period, noting any damage or deficiency. For this reason we require all Renters to be available at drop off and pick up times. Please allow yourself enough time for a complete walk-through before scheduling your fun.

 

7. No smoking is allowed in trailers and pets are only allowed by special arrangement with GTL.

 

8. Insurance: Renters are responsible for all damage costs to trailers, including loss of use, theft or acts of nature (wind, rain, earthquake, fire, flood, etc) while in their possession whether the Renter is at fault or not. The Renter is also liable for all injury or damage to themselves or others resulting from, or arising out of, use of this trailer. If an accident does occur the Renter is responsible for obtaining a police report, contacting the Renter’s insurance company and contacting Gorge Trailer Lodging immediately.

 

The Renter's insurance agent has been notified of Renter's intent to rent the trailer. A liability and property damage endorsement has been added to the Renters insurance policy that covers risk of loss to the trailer and Renter's/Occupant's risk of liability for injury or damage to others or their property. 9. Reservation Deposit: A non-refundable reservation fee of $200.00 is required for rentals made more than 30 days before contract period. Payment must be received within 3 days of the date the reservation is made. This reservation fee will be deducted from the final rental charge. Any rental made within 30 days of occupancy requires full payment.

 

10. Rental Payments: Full payment of rental fees (less deposit) is required to to be made at least 30 days prior to the rental date. Payments can be made by PayPal, cash, money order, cashiers check, or credit card through PayPal. We do not have the capability of charging credit cards at campsites or other physical locations. Any rental made within 30 days of occupancy requires full payment.

 

11. Cancellation Fee: Cancellations must be submitted in writing if the rental is cancelled within two weeks of the rental date, and the Renter forfeits 50% of the rental payment. If the Renter is a no-show or cancels one week prior to rental, there will be no refund. GTL will, in good faith, refund all but the $200.00 reservation deposit IF a replacement Renter can be found for the canceled time period.

 

12. Security/Cleaning Deposit: A security/cleaning deposit of $100.00 is required to cover damage or excessive cleaning expenses. An additional $100.00 cleaning/damage deposit is required if Gorge Trailer Lodging has agreed to allow Renter’s pet to stay in the trailer.

If the trailer is returned clean inside and out and free of damage, the fees will be mailed or credited to your credit card within one (1) week of rental. GTL requires trailers to be swept out, counters wiped down and garbage dumped. Reasons for not refunding the security deposit include but are not limited to, damaged or missing furnishings, spills or rips; pet or smoke damage; or inadequate cleaning.

 

13. Waiver of Liability: In consideration of being allowed to rent a trailer, the undersigned expressly waives and releases Gorge Trailer Lodging owners, administrators, directors, agents, officers, and employees, from any and all causes of action or claims whatsoever, of any kind or nature, arising from, or in any manner related to, Renter’s rental and use of the trailer. This Waiver and release shall insure to the benefit of the assigns or successors of owner and shall be binding upon the heirs or successors of Renter.

 

Renter specifically understands that use of the trailer is at Renter's own and sole risk. With full knowledge, the Renter fully accepts and assumes all risk and all responsibility for losses, costs, and damages incurred as a result of his use of the camper, of any kind or nature whatsoever.
 

Renter further agrees that if, despite the release, he or anyone on his behalf makes a claim against any of the releases named herein, Renter will indemnify, save and hold harmless each of the releases from any litigation expenses, attorney's fee, loss liability, damage, or cost any may incur as a result of any such claim.

 

Renter acknowledges that he has read this release, fully understands its terms, and has signed it freely and without any inducement or assurance of any nature, and intends same to be a complete and unconditional release of all liability to the greatest extent allowed by the law of the state in which such activity is conducted and further, agrees that if any portion of this release is held to be invalid that the balance, notwithstanding, shall continue in full force and effect.
